Welcome to rjmccowan.org, a website of RJ McCowan Ministries.  By accessing or using our website at www.rjmccowan.org (the “Website”) you (the “User” or “You” or “Your”) signify that you have read, understand, and agree to be bound by these Terms of Use (“Terms of Use” or “Agreement”).  The Website is the property of RJ McCowan Ministries (“RJMM”) and its licensors.  BY USING THE WEBSITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE THE WEBSITE.

RJMM reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without further notice.  It is your responsibility to periodically check these Terms of Use for changes.  Your continued use of the Website following the posting of changes means that you accept and agree to the changes.  As long as you comply with the Terms of Use, RJMM grants you a personal, non-exclusive, non-transferable, limited right to enter and use this Website.

All aspects of this Website, including but not limited to the text, user and visual interfaces, photographs, trademarks, logos, sounds, music, artwork, computer code, sermons, spiritual educational content (collectively “Content”), and the arrangement of such Content on the Website, is owned, controlled or licensed by or to RJMM, and is protected by United States and international copyright laws and various other intellectual property laws.

Except as expressly provided in these Terms of Use, no part of this Website may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way without RJMM’s express prior written consent.  RJMM considers framing, the practice of intact reproduction of a page or pages of one website into another website, to be deceptive and a violation of RJMM’s copyright rights.  No authorization or permission is given for framing (copying code or layout) of RJMM’s content, whether in whole or in part.

Your Use of the Site

You may not attempt to gain unauthorized access to any portion or feature of the Website or to any of the services offered on or through the Website, by hacking, or any other illegitimate means. You may not use the Website or any Content for any purpose that is unlawful or prohibited by these Terms of Use or to solicit the performance of any illegal activity or other activity which infringes upon the rights of RJMM.

Limitation of Liability

Except where prohibited by law, under no circumstances, including but not limited to negligence, will RJMM be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the Website, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, RJMM’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to RJMM to access or use this Website, but in no case will RJMM’s liability to you exceed $100.  You acknowledge that if no fees are paid to RJMM, you will be limited to injunctive relief only, unless otherwise permitted by law, and shall not be entitled to damages of any kind from RJMM, regardless of the cause of action.  Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, RJMM’s liability in such jurisdictions shall be limited to the extent permitted by law.

Indemnity

You agree to indemnify and hold RJMM, its subsidiaries, and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney’s fees, arising out of or in connection with, your access to or use of the Website, your conduct in connection with the Website, or any violation of this Agreement or of any law or the rights of any third party.

Violation of these Terms of Use

RJMM may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Website, or to identify, contact or bring legal action against someone who may be causing injury to or any interference with RJMM’s rights or property, or the rights or property of those individuals visiting RJMM’s Website.  RJMM reserves the right at all times to disclose any information that RJMM deems necessary to comply with any applicable law, regulation, legal process or governmental request.

Governing Law; Dispute Resolution

By visiting or using RJMM’s website or by participating in RJMM’s online community, except where prohibited, you agree that: (1) any and all disputes, claims, and causes of action arising out of or connected to your access to the website or participation in RJMM’s online community shall be resolved individually, without resort to any form of class action, and exclusively by mediation, and if not resolved by mediation, then by binding arbitration under the procedures and supervision of the Rules of Procedure for Christian Conciliation, Institute for Christian Conciliation, or similar faith-based mediation and arbitration group.  In the event that the Institute for Christian Conciliation ceases to exist during the course of this Agreement, arbitration under this section shall be conducted according to the rules of the American Arbitration Association; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with your access to the website but in no event attorney’s fees; and (3) under no circumstances will you be permitted to obtain awards for and you hereby waive all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of this Agreement, or the rights and obligations of you and/or RJMM in connection with your access to the website or participation in RJMM’s online community, shall be governed by, and construed in accordance with, the laws of the State of Texas without regard for conflicts of law doctrine, and all proceedings shall take place in Tarrant County, Texas. You understand that in accordance with this section, you have hereby waived any right to a trial by jury or trial before a judge.  If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from the Agreement and does not affect the validity and enforceability of any remaining provisions.

If a dispute may result in an award of monetary damages that could be paid under RJMM’s  insurance policy, then use of the conciliation, mediation, and arbitration procedure is conditioned on acceptance of the procedure by the liability insurer of RJMM and the insurer’s agreement to honor any mediation, conciliation or arbitration award up to any applicable policy limits.

General Terms

1.      Severability.

If any provision of this Agreement is found by a court of competent jurisdiction or arbitrator to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to effect the intention of the provision; and if a court or arbitrator finds the modified provision invalid, illegal, void or unenforceable, the validity, legality, and enforceability of the remaining provisions of this Agreement will not be affected in any way.

2.      Entire Agreement.

You understand and agree that this Agreement (the User Agreement and Privacy Policy, as incorporated) constitutes the entire, complete and exclusive agreement between you and us regarding the Services and supersedes all prior agreements and understandings, whether written or oral, or whether established by custom, practice, policy or precedent, with respect to the subject matter of this Agreement.

3.      Amendments to this Agreement.

RJMM reserves the right to modify, supplement or replace the terms of the Agreement without notifying you individually.  Any changes to the Agreement will be noticed on the online community website. If you do not want to agree to changes to the Agreement, you can terminate this Agreement at any time by deleting your account.

YOUR PRIVACY IS OUR CONCERN.

The protection of your privacy is very important to us here at RJ McCowan Ministries. We value your trust, and want you to understand what information we collect, how we protect it, and how it is used. Personal information—nonpublic information that identifies you—is essential to McCowan Ministries in meeting its goal to provide you with our ministry, services, and ministry-related products and so it will be treated with respect and in accordance with this Privacy Policy.

Any reference to “RJ McCowan Ministries” or “RJMM” within the context of this Privacy Policy is intended, and shall be considered to be inclusive of each and all entities operated by RJ McCowan Ministries, including all future International Offices.

 

SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our site, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. This enables us to both fulfill and support the products you purchase.

When you browse our site, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system so we can better improve the experience for all our users.

Email marketing: With your permission, we may send you emails about new products, free and premium content (like blog posts, content articles, YouTube videos, free product offers, live event alerts, etc.), and special announcements.

Mobile: When you download or use apps created by RJ McCowan Ministries or our subsidiaries, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with personalized content and location based interactions. Most mobile devices allow you to turn off location services. For more information about how to do this, we recommend you contact your mobile service carrier or your device manufacturer.

 

SECTION 2 – CONSENT

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason (i.e.  Daily devotional emails, newsletter subscription and announcements), we will ask you directly for your expressed consent and provide you with an opportunity to withdraw your consent.

You may withdraw your consent at any time by clicking on an “unsubscribe” link which is offered at the bottom of every email we send.

SECTION 3 – DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

IMPORTANT: We do not sell, rent or otherwise disclose your personal information to any third parties, including but not limited to advertisers, strategic partners or vendors. Again, we take your privacy very seriously.

 

SECTION 4 – DATA STORAGE

Our shopping cart solution is WooCommerce, it’s hosted and managed by RJMM. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through RJMM’s data storage, databases and the general DonorDirect application. RJMM stores your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Paypal stores your credit card data. Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

NOTE: At no point during the transaction does RJ McCowan Ministries take custody or store your credit card information. SECTION 5 – THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 6 – SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL). Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

 

SECTION 7 – COOKIES

RJ McCowan Ministries utilizes cookies to create a more customized experience for our users and customers. For example, we use a login cookie so members do not have to re-enter their username and password each time they return to our site. We also use tracking pixels (i.e. Google Analytics) to aid in measuring and tracking where our website traffic is coming from and to track the performance of our site. Finally, we use remarking pixels from Facebook and Google to aid in customized, targeted followup advertising.

 

SECTION 8 – AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
